1. Acceptance of Terms

By downloading, installing, or playing the Jerk4Kirk mobile game ("the Game"), you agree to be bound by these Terms of Service ("Terms"). The Game is published by ConsoleLog LLC ("we," "our," or "us"). If you do not agree to these Terms, do not install or play the Game.

2. Parody & Satire Notice

Jerk4Kirk is a work of parody and satire. All characters, "pundits," voiceovers, and scenarios depicted in the Game are fictional. Any resemblance to real persons, living or dead, real organizations, real news outlets, or real events is intended as commentary and is protected expression.

The Game is not affiliated with, endorsed by, or sponsored by any real-world media personality, news network, political party, candidate, organization, or company.

All projectiles in the Game are depicted as foam darts. The Game depicts no real-world violence and is not intended to encourage, condone, or promote violence against any real person.

3. Description of Service

Jerk4Kirk is a free-to-play tap-to-dodge arcade game for iOS and Android. It includes optional in-app purchases for cosmetic skins and consumable power-ups. The Game requires an internet connection to post and view leaderboard scores; offline play with local scores is also supported.

4. In-App Purchases

  • Cosmetic skins are non-consumable purchases that unlock a parody pundit appearance for your character. They do not affect gameplay difficulty or scoring.
  • Slow-Mo charges and Revives are consumable purchases that are spent during a single run.
  • Purchases are processed by Apple App Store or Google Play and governed by their respective terms. Refund eligibility is determined by the platform's refund policy.
  • Restoring purchases on a new device is supported via Settings → Restore Purchases. Anonymous accounts mean we cannot restore a purchase without a valid platform receipt.

5. Leaderboards & Anti-Cheat

Leaderboards display anonymous handles you choose. We reserve the right to remove scores or handles that:

  • Are obviously generated by automated tools or modified clients
  • Contain hate speech, slurs, harassment, or sexual content
  • Impersonate real people in a way likely to cause confusion
  • Promote real-world violence against any person or group

Removed scores cannot be restored. Repeated violations may result in your anonymous device id being prevented from posting future scores.

6. User Conduct

When playing Jerk4Kirk, you agree to:

  • Use the Game for lawful, personal, non-commercial purposes only
  • Not reverse-engineer, decompile, or extract source code from the Game
  • Not interfere with the Game's servers, APIs, or scoring system
  • Not use modified clients, automation, or score injection
  • Not impersonate others or misrepresent your scores publicly

7. Intellectual Property

The Jerk4Kirk game, its art, code, character designs, audio, animations, and branding are the property of ConsoleLog LLC. You receive a personal, non-exclusive, non-transferable license to play the Game on devices you own. You may not redistribute, repackage, or resell any part of the Game.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONSOLELOG LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE GAME. THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

In no event shall our total liability exceed the greater of (a) the amount you paid for in-app purchases in the 12 months preceding the claim, or (b) USD $20.

9. Indemnification

You agree to indemnify and hold harmless ConsoleLog LLC from any claims, damages, or expenses arising from your use of the Game or violation of these Terms.

10. Termination

We reserve the right to suspend or terminate access to the Game at any time, for any reason, without notice. You may stop using the Game at any time by uninstalling it from your device.

11. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Your continued use of the Game after any changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Game shall be resolved in the applicable state or federal courts.
